New 2020 Law

No Waving of Deductibles Bill: Texas HB 2102
Waiving insurance policy deductibles

Amarillo residents looking to install new roofing will have an added level of protection due to a new state law.

According to Texas’ new law, contractors and roofers are not allowed to waive an insurance deductible. This is a concentrated effort to help consumers avoid scams, especially after major storms. When an area experiences a major storm event, contractors are quick to arrive on the scene. While some businesses are legitimate and do good work, there are also scam artists who cut corners trying to make a quick buck. Instead of getting a quality roof, consumers get more problems due to poor workmanship and fake contracts.

Often, roofers or contractors that offer to waive deductibles are cutting corners on your roof repair. Offering to waive or absorb a homeowner’s deductible can be a big selling point for the contractor. To save further money, these contractors cut corners by using low quality products. They also may inflate the bill sent to the insurance company to cover the difference. This practice was made illegal with the new Texas law. The law went into effect on September 1, 2019. Roofers and contractors that violate this law could receive a fine of up to $2,000 and up to six months in jail. Insurance companies may require proof of deductible payment before paying the balance of your claim as an additional way to help protect customers.

If you are in the market for a new roof, you can take steps to avoid contractor fraud. It is important to get estimates written on company letterhead. These estimates should also have clear contact information included. When looking for a new roof, get more than one bid. This will help you determine bids that are too high or too low. Request references from your contractor and check them out. If a contractor presents out of town references, be very cautious. Established companies do not often solicit door to door. They will place signs in areas where they have completed work. Check with your neighbors to determine if they are satisfied with the work. Do not pay in full before the work begins, and be sure the work is completed to your satisfaction before making the final payment.
